Terms and conditions of sale

  1. ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
1.1 - The contract stipulated between SWI S.r.l. and the Customer shall be considered concluded with the acceptance, partial or whole, of the order by SWI S.r.l.. Such acceptance shall be deemed tacit, unless otherwise communicated in any way to the Customer. By placing an order in the various ways provided, the Customer declares that he/she has read and accepted all the information provided to him/her in the various phases of the purchase, and that he/she fully accepts the general conditions and payment terms.
 
1.2 - If the Customer is a private consumer (i.e. a natural person purchasing the goods for purposes that cannot be attributed to his or her professional activity), once the online purchase procedure has been completed, he or she shall print or save an electronic copy and in any case retain these general conditions of sale, in compliance with the provisions of Articles 50 et seq. of Legislative Decree No. 206/05.
 
1.3 - Any right of the Customer to damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the total or partial non-acceptance of an order and for any improper use of the products purchased.
 
1.4 - SWI S.r.l. reserves the right to cancel an order, against reimbursement of the amount paid by the purchaser, due to lack of availability of the material or for other reasons, even after payment. Any claim for compensation for non-availability of products is also excluded. The purchaser shall be entitled to a refund of the total amount paid or may claim a credit of equal amount for the choice of alternative products.
 
1.5 - SWI Srl is in possession of all products for which immediate availability is expressly indicated. All other products, for which the days required for shipment are estimated, are ordered from the respective suppliers at the time the order is accepted. The customer acknowledges that the estimated shipping date is purely indicative and is not binding in the relationship with the customer and third parties, therefore SWI srl shall not be liable for delays caused by lack of availability on the part of the supplier or for any delay not directly attributable to SWI Srl. If, for reasons of force majeure, it is not possible to complete the order even after the indicated time, upon the customer's request SWI Srl shall immediately refund the payment and cancel the order.
 
1.6 - SWI S.r.l. shall not be liable for damage caused during transport by the carrier, which is solely responsible for the goods transported. Any request for replacement, return or cancellation for this type of damage can only be made if at the time of delivery any damage to the packaging has been notified to the carrier by "signing with reservation". Any replacement of the product shall only be carried out after all investigations have been carried out upon return of the defective product, within and no later than 30 working days (subject to availability of the replacement).
  1. PURCHASING METHODS 
2.1 - The customer may only purchase the products in the online catalogue of the www.ib-100.com website at the time the order is placed, as described in the relevant technical and information sheets, unless improved by the manufacturer. It is probable that the image attached to a product description sheet may not be perfectly identical, but may differ in terms of colours, dimensions, products and accessories in the picture, or simply represent the product series or family. All information supporting the purchase (Glossary, Guides, etc.) is intended as mere generic information material, not referring to the real characteristics of an individual product. The price indicated in the product sheets includes VAT, at the rate in force in Italy.
 
2.2 - Receipt of the order is confirmed by SWI S.r.l. through an e-mail reply, sent to the e-mail address indicated by the Customer. This confirmation message will contain the Date and Time of the order and a Number, to be used in any eventual communication with SWI S.r.l.. The message shall contain the data entered by the Customer, who undertakes to verify their correctness and to promptly communicate any corrections, using any suitable means.
 
2.3 - In case of non-acceptance of the order, SWI S.r.l. shall promptly notify the Customer.
 
2.4 - SWI S.r.l. reserves the right to modify the prices indicated on the site www.IB-100.com without prior notice, but undertakes to apply the prices in force (i.e. those indicated on the site) at the time the order is placed, excluding calculation errors in the checkout system
  1. METHODS OF PAYMENT
3.1 - Payments can only be made through a PayPal account and, at the conclusion of the online transaction, PayPal itself will immediately debit the amount relative to the purchase made.
 
3.2 - During and after the purchase procedure, SWI S.r.l. is able to gain knowledge of information relating to the customer's PayPal account, transmitted through protected connections directly to the bank handling the transaction.
SWI S.r.l. can store this information only in case of explicit request and consent of the customer, moreover, it guarantees that this information is stored according to certified security standards and that it is always displayed in masked mode.
  1. DELIVERY METHODS AND COSTS 
4.1 - SWI S.r.l. can only accept orders with delivery both within Italian territory and within the European Community (Austria, Belgium, France, Germany, Luxembourg, Netherlands, Monaco, Spain, Croatia, Denmark, Finland, Greece, Ireland, Portugal, Sweden, Bulgaria, Estonia, Latvia, Lithuania, Poland, Czech Republic, Romania, Slovenia, Hungary), San Marino and the Vatican City. For inconvenient locations, minor islands, Livigno and Campione d'Italia and outside Europe, surcharges are foreseen which shall be expressly indicated before payment of the order.
 
4.2 - Sales made on www.ib-100.com are attributable to mail-order sales and therefore without the obligation to issue an invoice as provided for in Article 22 of Presidential Decree No. 633 of 1972, and without the obligation to issue a tax receipt as provided for in Article 2, letter oo), of Presidential Decree No. 696 of 21 December 1996. The tax invoice must be expressly requested before or at the same time as the order is placed.
 
4.3 - Delivery costs, if any, are borne by the Customer and are specified separately when placing the order. Nothing is owed by the Customer in addition to the order total.
 
4.4 - No responsibility can be attributed to SWI S.r.l. in the event of delays in processing the order or delivery by the carrier.
 
4.5 - Delivery of the order is intended at street level unless:
  • otherwise communicated to our customer service;
  • as provided for in the product specifications and data sheet.
Upon delivery of the purchased products, the Customer is obliged to check:
  • that the number of packages corresponds to that indicated in the order confirmation and in any subsequent communication
  • that the packaging is intact, not damaged, not wet or in any case not altered, including and especially the closing materials (adhesive tape or strapping).
Any damage to the packaging, to the product or the mismatch in the number of packages or any indications must be immediately contested, by affixing the wording RESERVE OF CHECK on the courier's delivery slip (accurately specifying the reason for the reservation, e.g. "punctured packaging", "crushed packaging", "open package"). Once the delivery note has been signed, it will no longer be possible to make any objection regarding the external characteristics of what has been delivered.
Any problems concerning the physical integrity, correspondence, completeness and correctness of the products received must be reported within 3 days of delivery, in accordance with the procedures set forth herein.
 
4.6 - In the event of failure to collect within 5 working days the purchased products in storage at the courier's warehouses due to repeated impossibility of delivery to the address indicated in the payment form by the Customer at the time of the order, the products ordered will be redelivered to the warehouses of SWI S.r.l.
 
4.7 - In the event of the return of one or more purchased products, refer to the procedures in point 5 RIGHTS OF WITHDRAWAL.
For products that the customer intends to return, the customer shall bear the full cost of returning the products to the warehouses of SWI s.r.l., otherwise the return request shall be cancelled.
In any case, for products delivered to countries other than Italy and for which the customer has expressed the desire to initiate a return request, the methods and costs necessary to return the products to the warehouses of SWI s.r.l. must be agreed upon before the transaction is carried out.
  1. RIGHT OF WITHDRAWAL
5.1 - Pursuant to Articles 64 et seq. of Legislative Decree No. 206/05, if the customer is a consumer (i.e. a natural person who makes purchases for purposes not related to his or her professional activity, i.e., who does not make the purchase by indicating a VAT number on the order form), he or she has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.
It is specified that there is no right of withdrawal for customised products.
 
5.2 - In order to exercise this right, the customer must, within 14 days from the date of receipt of the products, contact the IB-100 customer service at info@ib-100.com or send a communication by registered letter with acknowledgement of receipt, specifying that they wish to avail themselves of the right of withdrawal as in the model below.
SWI S.r.l.'s customer service manager will tell the customer how to pay the eventual return expenses as explained in point 4.7 and, once the product has been returned according to the modalities explained in point 4.7, SWI s.r.l. within 30 days from the return of the goods (period within which the integrity and functionality of the product and of the packaging will be checked), will refund the amount or replace the goods, after having checked the integrity of the goods. Orders previously paid for via PayPal account will be re-credited in the same form as the payment made when the order was placed.
The goods must be returned undamaged and functional, complete with all its components and in their original, undamaged packaging (envelopes and wrappings), stored and, if necessary, used according to normal diligence, in the total absence of wear and tear or dirt.
 
5.3 - The right of withdrawal is subject to these conditions:
  • it applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on a fraction of the product purchased;
  • it does not apply to custom-made or clearly customised products;
  • the purchased goods must be intact and returned in the original packaging, complete in all its parts (including packaging and any ancillary documentation); in any case, the affixing of labels or adhesive tape directly on the original product packaging must be avoided
  • the shipment and the integrity of the product, until its receipt in our warehouse, is under the full responsibility of the Customer;
  • upon its arrival in our warehouse, the product will be examined for damages, tampering and lack of parts;
  • SWI srl is not responsible in any way for damage, theft or loss of goods returned by uninsured shipments.
If the packaging and/or packing are damaged, SWI S.r.l. may withhold from the refund due a percentage, not exceeding 10% of it, as a contribution to the costs of restoration.
 
5.4 - The right of withdrawal lapses in full, due to the lack of the essential condition of integrity of the goods (packaging - contents), in cases where SWI S.r.l. ascertains
 
the unconventional use of the goods that has caused wear and tear or the use of any consumables
the absence of the outer packaging, the original inner packaging or part of it
the absence of integral elements originally attached to the product;
damage to the product for causes other than its transport.
In the event of forfeiture of the right of withdrawal, the goods will be made available to the Customer for collection at his expense at the headquarters of SWI S.r.l.
  1. LIABILITY
The user of the site is aware that he/she connects and uses the services offered by the site at his/her own risk. Under no circumstances shall SWI S.r.l. be held liable for direct or indirect damage (financial, pecuniary, economic losses) suffered by a user or a third party as a result of connecting to the site, the impossibility of accessing it, its good or bad functioning. 
 
The foregoing applies in particular to damages that may be caused by the presence of inaccurate content or errors, slow or interrupted data transmission, loss, disappearance or alteration of data, viruses, whatever their origin, intrusion by third parties, and, in general, by the use of our site or the impossibility of using it
  1. COMMUNICATIONS AND PERSONAL DATA PROCESSING 
With the entry into force of Legislative Decree 196/03, containing provisions for the protection of persons and other subjects with respect to the processing of personal data, the staff of SWI S.r.l., in its capacity as Data Controller, is required to provide certain information regarding the use of personal data.
 
7.1 With the acceptance of the General Terms and Conditions of Sale, the processing of personal data in accordance with the legislation in force shall also be deemed as signed and accepted.
 
7.2 By accepting the General Terms and Conditions of Sale, you also accept the receipt of communications of commercial offers via Newsletter or ordinary mail from SWI S.r.l., without prejudice to the possibility for the customer to cancel or unsubscribe at any time by sending a communication to the e-mail address info@ib-100.com.
 
7.3 The data shall be processed using instruments that guarantee security and confidentiality and the data shall be processed mainly by computer and stored on computer media, paper media and any other suitable media. Furthermore, we inform you that your personal data will be processed in compliance with the methods indicated in Legislative Decree 196/2003, which provides, among other things, that the data shall be
  • processed lawfully and fairly
  • collected and recorded for specific, explicit and legitimate purposes
  • accurate and, if necessary, updated
  • relevant, complete and not exceeding the processing formalities.
7.4 Data concerning domicile, telephone number, e-mail address and any additional information shall be communicated to the courier chosen for the shipment to facilitate delivery.
For each delivery order, the Customer shall specify at least one telephone number to allow the courier to contact him in the event of delivery difficulties.
Data processing is carried out by any data processor and by the persons in charge appointed in advance in accordance with articles 29 and 30 of the GDPR regulations, who operate under the control and responsibility of the Data Controller.
  1. PROMOTIONS AND DISCOUNTS
The promotions and discount vouchers on www.ib-100.com cannot be combined with each other unless otherwise indicated.
  1. CURRENT LEGISLATION AND JURISDICTION
These Conditions of Sale may be modified by SWI Srl without prior notice and shall be valid from the date of publication on the website www.IB-100.com. It is understood that these Terms of Sale are in any case subject to Italian law and all disputes shall fall under the exclusive jurisdiction of the Court of Monza.
